Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the TeeWise mobile application, website, and related services (collectively, the “App” or “TeeWise”). TeeWise is operated by TeeWise Inc. (“TeeWise,” “we,” “us,” or “our”).

By downloading, installing, creating an account, accessing, or using TeeWise, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, do not use the App.

1. Acceptance of Terms

By using TeeWise, you confirm that:

• you are at least 18 years of age, or have reached the legal age of majority in your province, territory, state, or country of residence;
• you have read, understood, and agree to these Terms;
• you have read and understood our Privacy Policy;
• if you are under 18 or under the legal age of majority in your province, territory, state, or country of residence, your parent or legal guardian has reviewed and agreed to these Terms on your behalf;
• you have the legal authority to enter into these Terms.

TeeWise is not intended for users under 18 or under the applicable age of majority. Users between 14 and 18 (or under the applicable age of majority) may use TeeWise only with verified parental or guardian consent and agreement to these Terms. If we discover that a user under the applicable minimum age has created an account without appropriate consent, we may suspend or delete the account and associated information.

Nothing in these Terms limits any mandatory consumer protection, privacy, or other legal rights that cannot be waived under the laws of your province, territory, state, or country of residence.

2. Description of Service

TeeWise is a community-powered golf course conditions and round-tracking app. The App may allow users to:

• view and submit golf course condition reports;
• submit post-round condition reports following round completion;
• rate and review golf courses;
• upload golf course condition photos;
• access course information, scorecards, and course details;
• track golf rounds and scores, including hole-by-hole scoring, putts, fairways in regulation, greens in regulation, tee shot direction, and round history;
• access Pro features (where subscribed), including first putt distance tracking, club selection tracking, penalties and hazards detail, scorecard access mid-round, hole history, stats and analytics, conditions impact analysis, and dark mode;
• favourite courses;
• connect with other golfers through Crew features (Crew is TeeWise's in-app social connections feature that allows users to connect with, follow, and share golf activity with other golfers);
• like and confirm community condition reports;
• participate in leaderboards, Golfer DNA identities and archetypes (algorithmically assigned golf personas — such as "The Closer," "The Scrambler," or "The Bomber" — derived from your round data, stats, and playing behaviour and displayed on your profile and within App features), handicap trend tracking, or gamified features;
• access free and paid (Pro) features.

TeeWise is currently focused on golf courses in Ontario, Canada. We may add, remove, modify, limit, suspend, or discontinue features at any time.

TeeWise is not a booking platform, emergency service, weather-warning service, safety service, or official golf course operations system.

3. App Store and Platform Terms

Your download and use of TeeWise may also be subject to the applicable terms of the Apple App Store, Apple Media Services, Google Play, or other platform from which you downloaded the App.

Apps downloaded through the Apple App Store are licensed, not sold. If you access TeeWise through an Apple device, you acknowledge that these Terms are between you and TeeWise Inc., not Apple. Apple is not responsible for the App, App content, maintenance, support, or claims relating to the App, except as required by applicable Apple terms or applicable law.

If there is a conflict between these Terms and mandatory Apple App Store, Google Play, or platform terms, the applicable platform terms will apply to the extent required.

4. Account Registration

4.1 Account Creation

To use most TeeWise features, you must create an account. You agree to:

• provide accurate, current, and complete information;
• keep your account information updated;
• maintain the confidentiality of your login credentials;
• notify us promptly of unauthorized account access or suspected security issues;
• accept responsibility for activity that occurs under your account, except where prohibited by law.

We may refuse, suspend, or terminate accounts that violate these Terms or create risk for TeeWise, other users, golf courses, or third parties.

4.2 One Account Per User

You may only create and use one TeeWise account unless we give written permission otherwise.

Creating multiple accounts to manipulate course reports, ratings, reviews, leaderboards, Crew features, promotions, subscriptions, or other App functions is prohibited and may result in suspension or permanent termination.

5. User-Generated Content

5.1 Your Content

TeeWise may allow you to submit, upload, post, display, or transmit content, including:

• condition reports and post-round condition entries;
• ratings and reviews;
• comments;
• photos;
• scores and round information;
• profile information;
• Crew-related content;
• likes and confirmations on community posts;
• other App activity or submissions.

This is referred to as “User Content.”

You retain ownership of your User Content, subject to the license granted below.

5.2 License to TeeWise

By submitting User Content, you grant TeeWise Inc. a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, modify, adapt, distribute, and otherwise use your User Content solely for the purpose of operating, providing, improving, promoting, securing, and developing TeeWise and related services.

This license continues for as long as your User Content remains available in the App. If you delete your User Content or account, we will handle the associated information in accordance with our Privacy Policy. However, anonymized, aggregated, de-identified, backup, previously shared, or legally retained content may continue to be used where permitted by law.

5.3 User Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• your User Content is accurate to the best of your knowledge;
• you own or have the necessary rights to submit your User Content;
• your User Content does not violate the rights of any person, golf course, business, or third party;
• your User Content does not violate these Terms or applicable law.

5.4 Photos and Uploaded Media

You may only upload photos, images, or other media that you own or have permission to use.

You may not upload content that infringes copyright, trademark, privacy, publicity, confidentiality, or other rights of another person or business.

You should not upload photos containing private, sensitive, personal, or identifying information that you do not want visible to other users.

5.5 Content Standards

You agree that your User Content will not:

• be false, fabricated, misleading, or deceptive;
• be defamatory, abusive, harassing, threatening, hateful, discriminatory, or malicious;
• be obscene, sexually explicit, excessively vulgar, or otherwise inappropriate;
• infringe intellectual property, privacy, publicity, or other rights;
• disclose another person’s private information without consent;
• impersonate another person, golf course, business, or organization;
• contain spam, advertising, scams, or unauthorized promotions;
• contain malware, malicious code, scraping instructions, or harmful technical content;
• violate applicable law.

6. Accuracy of Condition Reports

TeeWise is a crowdsourced platform. Condition reports — including both in-app posts and post-round condition entries — reflect the personal observations of individual users and are not independently verified by TeeWise.

Users agree to submit condition reports only based on genuine personal observations from an actual visit to the golf course. You may not post fabricated, false, stale, manipulated, or misleading condition reports.

Condition reports are intended to reflect objective, factual course conditions, such as greens, fairways, bunkers, pace of play, cart access, range status, food and beverage availability, and similar course-related information.

TeeWise does not guarantee the accuracy, completeness, reliability, or timeliness of any condition report, course rating, course review, leaderboard, course information, weather information, scorecard, or other App content.

Users should use their own judgment and confirm important information directly with the golf course.

7. Content Removal, Reporting, and Course Disputes

We reserve the right, but are not obligated, to monitor, review, remove, restrict, or edit User Content at any time if we believe it violates these Terms, creates legal risk, harms the TeeWise community, or is otherwise inappropriate.

Users may report content they believe violates these Terms by using the in-app reporting tools where available or by contacting: support@teewiseapp.com

Golf courses, course representatives, businesses, or affected parties may contact us to request review of content they believe is false, misleading, defamatory, infringing, or otherwise harmful.

We aim to review such requests within a reasonable time, typically within 5 business days where practical. We do not guarantee a specific review timeline.

TeeWise may remove, limit, or leave content available at our discretion, subject to applicable law.

8. Golf Course Rights and Verified Course Accounts

TeeWise respects the rights, reputations, and operations of golf courses listed in the App.

Unless expressly stated, TeeWise is not affiliated with, endorsed by, sponsored by, or officially connected to any golf course, golf club, municipality, association, or course operator listed in the App.

Golf courses may be able to claim or verify their listing through TeeWise’s course verification program where available. Verified course accounts may be able to post official updates, course information, or condition notices.

Verification does not guarantee that all course information in the App is accurate, complete, or current.

Nothing in these Terms prevents users from sharing honest, factual observations or genuine experiences about publicly accessible golf facilities in accordance with applicable law.

8.1 Course Operator Portal

TeeWise may offer a course operator or verified business portal that allows golf course operators, representatives, or administrators to claim or manage their course listing within TeeWise. If you are a course operator or representative accessing TeeWise through such a portal:

• Your use of the portal is subject to these Terms and any additional terms disclosed to you at the time of registration for that portal.
• You represent and warrant that you have authority to act on behalf of the golf course or business entity whose listing you are managing.
• You may only post accurate, truthful, and lawful information about the course or facility you represent.
• You may not use the portal to post misleading information, remove or suppress legitimate user reviews or condition reports, or otherwise manipulate TeeWise community features.
• TeeWise does not grant course operators access to identifiable individual user data through the portal.

TeeWise reserves the right to revoke portal access at any time for violation of these Terms or for conduct that harms the TeeWise community.

9. Prohibited Conduct

You agree not to:

• post false, fabricated, manipulated, or misleading course conditions;
• manipulate ratings, reviews, leaderboards, reports, rankings, or gamified features;
• create multiple accounts to abuse the App;
• harass, threaten, abuse, stalk, or target other users;
• impersonate another person, golf course, business, or organization;
• attempt unauthorized access to accounts, systems, databases, or networks;
• use bots, scripts, crawlers, scrapers, automation, or bulk-posting tools without written permission;
• scrape, copy, harvest, resell, or redistribute App content without written permission;
• reverse engineer, decompile, modify, or tamper with the App;
• bypass security, rate limits, access controls, or technical restrictions;
• upload malicious code, viruses, or harmful content;
• use the App to train artificial intelligence models or datasets without written permission;
• circumvent, share, or otherwise abuse subscription access, including sharing Pro account access with non-subscribers;
• use the App for unlawful, fraudulent, harmful, or abusive purposes.

10. Intellectual Property

All content, design, software, code, databases, features, trademarks, logos, graphics, icons, trade names, branding, and materials within TeeWise, excluding User Content, are owned by TeeWise Inc. or its licensors.

The TeeWise name, logo, symbols, icons, and brand assets are trademarks, trade names, or brand assets of TeeWise Inc. The tagline “Play Smarter” is a brand expression used by TeeWise Inc. and is not currently a registered trademark.

You may not copy, modify, reproduce, distribute, display, sell, license, reverse engineer, or create derivative works from TeeWise intellectual property without our prior written consent.

Subject to your compliance with these Terms, TeeWise grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use.

11. Course Information, Pricing, Weather, and Availability

Course information displayed in the App, including pricing, hours, scorecards, amenities, contact details, tee-time details, range status, cart access, food and beverage availability, and course conditions, is provided for informational purposes only.

This information may be incomplete, outdated, inaccurate, or based on user submissions.

Weather information, including radar and atmospheric data, may be provided through third-party sources and Canadian government open data sources (including Government of Canada weather radar datasets made available under the Open Government Licence — Canada). Such information may not reflect real-time or precise conditions at any specific golf course location. The Weather Pulse feature, where available, provides general regional weather radar information for informational purposes only and does not constitute an official weather warning, safety advisory, or emergency notification service.

You should confirm tee times, closures, pricing, hours, policies, weather risks, cart restrictions, frost delays, course rules, and other important details directly with the golf course before travelling, booking, paying, or playing.

TeeWise is not responsible for losses, missed tee times, travel costs, booking issues, disputes, injuries, or decisions based on App information.

12. Free Tier, Advertising, and Pro Features

TeeWise offers a free tier and an optional paid TeeWise Pro subscription.

The free tier is supported by advertising and includes basic round tracking, the course conditions feed, posting condition updates, Crew and friends features, and leaderboard access.

TeeWise Pro unlocks additional features as described in Section 13 and in the App at time of purchase. Pro features and the free/Pro boundary may change over time.

Advertising may be displayed in the App. Advertising is provided by third-party advertising partners and may be subject to their own terms, privacy policies, and consent requirements. TeeWise Pro subscribers may have a reduced or ads-free experience as described in the App.

13. TeeWise Pro Subscription

13.1 Pro Subscription

TeeWise may offer an optional paid subscription (“TeeWise Pro”) that unlocks additional features, including first putt distance tracking, club selection tracking, penalties and hazards detail, scorecard access mid-round, hole history, detailed stats and analytics, conditions impact analysis, and dark mode.

Current pricing, billing period, renewal terms, taxes, trial details, and available features will be displayed before purchase in the App and/or the applicable app store. Features available under TeeWise Pro may change over time.

13.2 Billing

Subscriptions are billed through the Apple App Store or Google Play Store, depending on your device and purchase method.

By purchasing a subscription, you authorize the applicable app store to charge your selected payment method according to the subscription terms shown at purchase.

13.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before renewal according to the rules of the applicable app store.

You are responsible for managing and cancelling your subscription through your Apple App Store or Google Play account settings. TeeWise will provide instructions or links in the App where practical to help you access the applicable subscription-management page.

13.4 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play account settings.

Cancellation generally takes effect at the end of the current billing period. You will normally retain access to Pro features until the end of the period already paid for, subject to applicable app-store rules.

Deleting the App or deleting your TeeWise account does not automatically cancel an app-store subscription. You must cancel the subscription directly through the applicable app store.

13.5 Refunds

Subscription payments are processed by Apple or Google. Refund requests are subject to the refund policies and procedures of the Apple App Store or Google Play Store.

TeeWise does not directly process app-store subscription refunds unless required by applicable law or app-store rules.

13.6 Free Trials and Promotions

If a free trial, discount, promotion, or introductory offer is available, the terms will be disclosed before sign-up.

Unless otherwise stated, subscriptions may automatically renew at the regular price after a trial or promotional period unless cancelled before renewal. Unused portions of a free trial may be forfeited if you purchase a subscription before the trial ends, subject to applicable app-store rules.

13.7 Price and Feature Changes

TeeWise may change subscription pricing, features, or plans from time to time. Any price changes for existing subscribers will be handled through the applicable app store and in accordance with applicable law and platform rules.

13.8 Subscription Sharing

TeeWise Pro subscriptions are personal and non-transferable. You may not share, sell, transfer, or grant access to your Pro subscription or Pro features to any other person or account. Violation of this restriction may result in suspension or termination of your account and subscription.

14. Round Data and Stats

TeeWise stores round data, hole-by-hole scoring information, and stats you enter in the App. This data is associated with your account and may be used to calculate handicap trends, display leaderboard rankings, and power analytics features.

You are responsible for the accuracy of the round data you enter. TeeWise does not independently verify scores, handicap inputs, or round information submitted by users.

Round data and stats are not intended to serve as official handicap records or official scoring for tournaments, competitions, or other formal golf purposes. For official scoring purposes, use an authorized handicap system recognized by your applicable golf association.

If you delete your account, your round data will be deleted in accordance with our Privacy Policy and the account deletion process described therein.

15. Push Notifications and Electronic Communications

TeeWise may send push notifications related to course conditions, Crew activity, app updates, reminders, account activity, or other App features if you enable notifications.

You can manage or disable push notifications through your device settings.

TeeWise may send service-related messages about your account, security, support requests, transactions, subscriptions, or use of the App.

We will only send marketing or promotional electronic messages where permitted by law and will provide an unsubscribe mechanism where required.

16. Privacy

Your use of TeeWise is subject to our Privacy Policy, which explains how we collect, use, disclose, retain, and protect personal information.

By using TeeWise, you acknowledge that you have read and understood our Privacy Policy.

17. Third-Party Services and Links

TeeWise may integrate with or link to third-party services, including app stores, maps, weather providers, email providers, payment processors, subscription management providers, advertising networks, golf course websites, booking systems, or analytics providers.

Third-party services are not controlled by TeeWise and may be subject to their own terms, policies, fees, and privacy practices.

TeeWise is not responsible for third-party services, websites, content, errors, outages, security, privacy practices, payments, bookings, or disputes.

18. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEEWISE INC. DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, OR ERROR-FREE OPERATION.

TEEWISE DOES NOT WARRANT THAT:

• THE APP WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE;
• COURSE INFORMATION WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE;
• CONDITION REPORTS WILL REFLECT ACTUAL COURSE CONDITIONS;
• WEATHER, MAP, SCORECARD, PRICING, OR AVAILABILITY INFORMATION WILL BE ACCURATE;
• USER CONTENT WILL BE TRUTHFUL, LAWFUL, OR APPROPRIATE;
• ROUND DATA, STATS, HANDICAP TRENDS, OR LEADERBOARD INFORMATION WILL BE ACCURATE OR SUITABLE FOR OFFICIAL GOLF PURPOSES;
• DEFECTS OR ERRORS WILL BE CORRECTED.

You use TeeWise at your own risk.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEEWISE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, AGGRAVATED, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, PROPERTY DAMAGE, TRAVEL COSTS, MISSED TEE TIMES, BOOKING ISSUES, OR DAMAGES ARISING FROM RELIANCE ON COURSE INFORMATION OR USER CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEEWISE INC.’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF:

• CAD $100; or
• THE AMOUNT YOU PAID TO TEEWISE INC. FOR THE APP OR SUBSCRIPTION IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, intentional misconduct, fraud, or mandatory consumer protection rights.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TeeWise Inc. and its officers, directors, employees, contractors, agents, service providers, licensors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or relating to:

• your use or misuse of the App;
• your User Content;
• your violation of these Terms;
• your violation of applicable law;
• your violation of another person’s or business’s rights;
• false, misleading, defamatory, infringing, or unlawful content submitted by you.

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification, in which case you agree to cooperate with us.

21. Suspension and Termination

We may suspend, restrict, or terminate your account or access to TeeWise at any time if we believe:

• you violated these Terms;
• your content creates legal, safety, security, reputational, or operational risk;
• your account is being misused;
• your activity harms TeeWise, users, golf courses, or third parties;
• we are required or permitted to do so by law.

We may also discontinue, suspend, or modify the App or any feature at any time.

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, User Content licenses, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

Termination or suspension of your TeeWise account does not automatically cancel any active app-store subscription. You remain responsible for managing your subscription through the applicable app store.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Before starting a formal claim, you agree to contact us at support@teewiseapp.com so we can attempt to resolve the dispute informally.

If informal resolution fails, the parties may attempt non-binding mediation in Barrie, Ontario, unless another location or method is required by applicable law.

Subject to mandatory consumer protection laws that may apply to you, any court proceeding arising from these Terms or the App will be brought in the courts of Ontario.

Nothing in this section limits rights that cannot be waived under applicable consumer protection, privacy, or other laws.

23. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will provide notice by posting the updated Terms in the App, updating the “Last Updated” date, and, where appropriate, notifying you by email or in-app notice.

Your continued use of TeeWise after updated Terms take effect means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

24. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms presented in the App, form the entire agreement between you and TeeWise Inc. regarding your use of TeeWise.

If any part of these Terms is found invalid or unenforceable, the remaining sections will remain in effect.

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

You may not assign or transfer these Terms without our prior written consent. TeeWise Inc. may assign these Terms as part of a merger, acquisition, financing, restructuring, sale of assets, or similar transaction.
